These terms apply to everyone who uses Aiyo Tickets (the website, ticket links, SMS and the gate app) to buy tickets, book experiences, reply to invitations, or sell. Aiyo Tickets is run by Sharet Africa ("we", "us"), a business registered in Kenya. By buying, booking, replying to an invitation or opening an account you agree to these terms, our privacy policy and our refund and cancellation policy.
1. What we do
Aiyo Tickets is a marketplace. Organisers (promoters, venues, tour operators, hosts) list events, experiences and invitations; we sell the tickets and collect payment as the organiser's agent. Your contract for the event or experience itself is with the organiser named on the listing. The organiser is responsible for the event: its content, line-up, safety, permits, timing, and age and entry rules. We are responsible for selling and delivering your tickets correctly, keeping your payment safe and handling refunds as these terms and our refund policy describe.
2. Using the site
- You can buy without an account (guest checkout). Your tickets go to the phone number and email you give, and you can get them again any time from Find my tickets.
- You must be 18 or older to buy, or buy with the permission of a parent or guardian. Some events set a higher age; the organiser or venue may ask for ID at the gate.
- Give accurate details. If you open an account, keep your password private; you are responsible for what is done with it until you tell us it has been compromised.
3. Prices and payment
- Prices are in Kenya shillings (KES) and are the full price you pay. There is no booking or processing fee on top: payment charges are paid by the organiser, not you. Where the organiser is registered for VAT, the price includes it.
- Payment is by M-Pesa (STK push to your phone, or Paybill). Your order is confirmed only when Safaricom confirms the payment; until then the tickets are held for you for a few minutes and then released.
- We never ask for your M-Pesa PIN by phone, SMS or email. Anyone who does is not us.
- Vouchers and promo codes apply only as stated, can't be exchanged for cash and can't be combined unless the listing says so.
- You receive a receipt with your order number (it starts with ORD-) and the M-Pesa reference.
4. Your tickets
- Each ticket has its own QR code and admits one person once. The first scan at the gate uses it. Keep your ticket link private: anyone holding the code can use it, and we can't let in two people on one code.
- Tickets are personal to the buyer and the names on them. You may pass a ticket to a friend for free or at face value. Selling tickets above face value, or buying in bulk to resell, is not allowed; we may cancel such tickets without a refund.
- Tickets copied, altered, or bought with stolen or reversed payments are void.
5. Lipa mdogo mdogo (pay in instalments)
- Where a listing offers it, you pay a deposit now and the balance in instalments by the due date shown before you pay. There is no interest and no extra fee. It is a layaway plan, not a loan, and we do not check or report your credit.
- Your place is held by the deposit. Tickets or booking confirmations are issued once the balance is fully paid.
- We send reminders before each due date. If the balance is not paid by the final due date, the booking lapses as set out in the refund policy (section 4).
6. Experiences (trips, tours, race packages, medical and sports travel)
- The tour operator or host named on the listing provides the trip, transport, accommodation and activities, and must hold any licence the law requires for them (for example from the Tourism Regulatory Authority).
- You are responsible for your travel documents (passport or EAC travel document, visas, and health certificates such as yellow fever where required), and for being fit to take part. We recommend travel and medical insurance.
- Itineraries can change for weather, safety, border or park rules. The operator will offer a reasonable alternative or a refund for what can't be provided.
- Prices on the listing show what is included. Extras marked as optional are paid only if you choose them.
7. Invitations
- Hosts who send invitations through Aiyo Tickets confirm they have their guests' permission to contact them by SMS, WhatsApp or email about the function, and that they will use the guest list only for that function.
- Guests can open, reply to and decline an invitation without an account. Entry passes are personal and admit the number of people shown.
8. At the event
Organisers and venues may search bags, refuse entry or remove anyone for safety reasons, for breaking venue rules or the law, for being under the age limit, or for holding a ticket that has already been used. Re-entry is at the organiser's discretion. Recording and photography rules are set by the organiser.
9. Changes, postponements and cancellations
If an event is cancelled, you get a full refund. If it is postponed, your ticket stays valid for the new date and you can ask for a refund for a limited time. If it changes materially (for example the headline act or the venue city), you can ask for a refund. Details and time limits are in the refund and cancellation policy.
10. Organisers
- Approval. Organisers must apply and be approved before selling. We verify identity and business details (ID or passport, company registration where it applies, KRA PIN, and payout account), and may ask for more at any time. We may decline or suspend an account that gives false details or puts buyers at risk.
- Your listings. You are responsible for the accuracy of your listings and for the event as advertised, for permits and licences (county, venue, Kenya Film Classification Board, music copyright licences, Tourism Regulatory Authority and any others that apply), and for your own taxes.
- Our fee. We charge a commission of 5% per person on the listed ticket price, plus VAT at 16% on the commission, unless your written agreement with us says otherwise. Vouchers you offer reduce what the buyer pays, not our commission. Free tickets and invitations carry no commission unless agreed. Each statement carries an eTIMS reference.
- Payment charges. M-Pesa, bank and card charges and any other external costs of collecting and paying out your sales are deducted from your payout.
- Payouts. Sales are held for you and paid out after the event ends, less our fee, payment charges and any refunds owed to buyers. We may hold back money where there are complaints, reversals or signs of fraud until they are resolved.
- Advance on sales. Where offered, you may draw up to 50% of sales already collected but not yet paid out. An advance is repaid first from your payout. If the event is cancelled, refunds to buyers come first and you must repay any advance not covered by remaining sales.
- Cancelling. If you cancel or materially change an event, buyers must be refunded. We refund them from the sales we hold; anything short is a debt you owe us.
- Buyer data. You receive buyers' names, contacts and ticket details to run your event. You must handle them under the Data Protection Act, 2019, use them only for that event (or for marketing only where the buyer agreed), and not sell them.
11. Acceptable use
Don't use Aiyo Tickets for anything unlawful, to mislead buyers, to forge or copy tickets, to resell above face value, to scrape or overload the site, to probe or break its security, or to access accounts or data that are not yours. Misuse may be an offence under the Computer Misuse and Cybercrimes Act, 2018. We may cancel orders, close accounts and report misuse to the authorities.
12. Our content
The Aiyo Tickets name, logo, design and software belong to Sharet Africa. Organisers keep the rights to their own images and text and allow us to show them to promote their listings. Photos credited to others are used under their licences.
13. Liability
- Nothing in these terms limits your rights under the Consumer Protection Act, 2012 or any other law that can't be excluded.
- We are not responsible for the event or experience itself, or for loss, injury or damage at it, unless caused by our own negligence. Claims about the event are with the organiser; we will help you reach them and will process refunds that are due.
- Where the law allows, our total liability to a buyer for an order is limited to the amount paid for that order.
- We are not liable for delays caused by events outside our reasonable control, such as M-Pesa or network outages, power failure, or government action. Payments confirmed during an outage are honoured once the service returns.
14. Messages we send
By buying or replying you agree to receive messages needed for your order (tickets, receipts, instalment reminders, changes to the event) by SMS, WhatsApp or email. Marketing is sent only with your consent, and every marketing message tells you how to stop it.
15. Complaints and disputes
Contact us first at info@aiyotickets.com with your order number. We acknowledge complaints within 2 working days and aim to resolve them within 10 working days. If we can't agree, either side may refer the dispute to mediation in Nairobi. You may also go to the Small Claims Court or the Competition Authority of Kenya (consumer protection). These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.
16. Changes to these terms
We may update these terms. The version that applies to an order is the one shown when you placed it. We post changes here with the date above, and tell organisers about material changes at least 14 days ahead.
